PARTICIPANT, AGREEMENT AND ACKNOWLEDGEMENT FORM

I accept that the content that’ll be owned by XP FACTORY is subject to use by other brands/individuals at XP FACTORY’s discretion. Including but not limited to George Bacon Media LTD.
I have no rights to the Images; all rights to the Images belong to XP Factory. XP Factory will own all proprietary rights to the Images including the right to distribute and use as XP Factory properly sees fit in its absolute discretion, always acting with the purpose of promoting brands owned by XP Factory.
I have no right to additional Consideration, and that I will make no claim for any reason to XP Factory.
This Agreement is binding upon my successors in title.
This Agreement is irrevocable, worldwide and perpetual, and will be governed by the laws of England and Wales.
I accept that the Event may require physical activity and should any injury occur, XP Factory shall bear no liability or responsibility for the same so far as the law permits.

PERMISSION AND RIGHTS GRANTED
For good and valuable Consideration, which I herein acknowledge as received, and by signing this Agreement, I hereby give XP Factory (and trading as “Boom Battle Bar”) my permission to license the Images and to use the Images in any Media for the advertising, promotion, marketing and packaging or other reasonable use for any XP Factory product or service. I agree that the Images may be combined with other images, text and graphics, and cropped, altered or modified without the need to inform me.

SCHEDULE DEFINITIONS

“AGREEMENT” means this image and video release agreement.
“INDIVIDUAL” means me and includes my appearance, likeness and form.
“MEDIA” means all media including digital, electronic, print, television, film and other media now known or yet to be invented.
“IMAGES” means all photographs, film or recording (including videos) or any other visual content taken of me as part of the Shoot.
“CONSIDERATION” means something of value I have received in exchange for the rights granted by me in this Agreement.
“EVENT” means the photographic or film session, event, venue visit or any other activity where I am present at an XP Factory venue or XP Factory event, which may for the avoidance of doubt be a period of an hour or a period of several days or months.
“EVENT DAY/ PERIOD” means the date(s) infilled above.
“XP FACTORY” means XP Factory plc as detailed in the footer to this Agreement.

BY CLICKING THE ‘SUBMIT WAIVER(S)’ BUTTON BELOW, I CONFIRM MY FULL AGREEMENT TO THE ABOVE AND I WAIVE ALL RIGHTS THAT I MAY OTHERWISE HAVE IN RELATION TO ANY LOSS OR PERSONAL INJURY SUFFERED EITHER DIRECTLY OR INDIRECTLY BY VISITING A BOOM BATTLE BAR WHETHER OR NOT I PARTICIPATE IN ANY ACTIVITIES.
